Dear Analog Fan,

Thank you for  your interest in the analog synthesizers, rhythm machines, tape loops  and other goods that I offer. Below you will find "The Transaction Propositions", which outlines how I make deals with my customers.  Please read this carefully. If it seems too much of a formality, remember that it is an attempt to protect both you and me from unwilling misunderstandings. I end this introductory word with my business motto, which is valid regardless of the way a transaction is done, either over Internet or in the real world:

0. Formal Notes on Collecting and Trading

Synthesizers, rhythm machines and other goods (in further text "goods") that you have found on my Web page are from my private collection, which I posses and build for collecting and hobby purposes only. That is to say that no special profit is made by selling/exchanging the specified items. The only purpose of my activity is to enlarge my collection with new items. Also, all the machines are second hand, not new. This means that appropriate taxes and custom duties have already been charged and paid, prior to coming into my possession. I don't own a trade company nor a merchant account, and am not able to issue an official receipt (see also the unacceptable ways of payment).


1. Identity and Credibility

My artistic name is Robert Lexton, and my real name is Robert Logozar. I am the author of the Web page: Robert L's Analog Synths (placed on the http://www.student.foi.hr/~rlogozar/mbsn1/AnalogSynths.html, whereto my domains www.robertlexton.com and www.lexonic.com are redirected to for the time being). I am the sole user of the email address: lexonic(AT)email.t-com.hr, robertlexton(AT)email.t-com.hr, robert.logozar(AT)vz.t-com.hr (in this email addresses the obvious change of (AT) into the @ sign must be done).

1.1 Credibility Details

You can find many details about me following the link Robert L. from my home page, at the URL: http://www.student.foi.hr/~rlogozar/robertlex.html. My Web pages are (for now) situated at the FOI college (http://www.foi.hr), where I work as an associate assistant. It is situated in town of Varazdin, in Croatia, Europe, where I also live, on the address specified above. My fixed phone line is connected to the same address. Note that my Analog Synths pages are situated on the same server:  http://www.student.foi.hr/~rlogozar/mbsn1/AnalogSynths.html. My Internet domains www.robertlexton.com and www.lexonic.com are redirected to the same server Web pages.
    You are welcome to contact me by phone to my fixed line number, or by any other communication channel you find appropriate to ensure my identity. 1.2 Recommendations

2. Payment

Generally, you are required to do the payment prior sending the goods. The packing and shipping price must be added to the price of goods. 
   Make your payment in Euros (EUR)  (e.g. if paying from Europe ), or in US$ if paying from elsewhere in the world. UK pounds and Swiss franks are also acceptable. You can expect the package in about  2-3  weeks after I receive the money.

2.1 Check Payment

Checks from internationally renowned banks are welcome. Just take into consideration that sending a check takes from 5-7 days within Europe, and 10-15 days from overseas. Please make sure that the check is chargeable in Croatia, and make it payable to (see also Paragraph 1.1):

2.2 Bank Account Payment

The money can be transferred by money wire (SWIFT) to my bank account. It usually takes 2-3 days from anywhere in the world. As for the transaction description necessary when wiring the money, you can use the parts of the afore mentioned Agreement, but please note that: 

The Agreement is not a bill, neither I own a service, nor a company with a merchant account to issue an official bill (check also the Paragraph 0 above).

Also take into consideration two important things:

i) Because of the small volume of trade and the fact that for now this is on a hobby level, please specify that the payment is::
--
GIFT / HELP to a private person (this simplifies the bank procedure for me).

ii) All transaction expenses must be paid by the payer (i.e. by you), and will not be covered by the payee (Robert Logozar).

The bank account details will be sent to you in an email message together with an Agreement in which all the transaction details will be specified. For smaller items, like the tape loops, you can calculate the price yourself and go to the Bank Account Details to get all the information needed.

After you make the payment, please inform me about when the money can be expected in my bank in Croatia.

2.3 Western Union

Western Union payment is welcome, but since the company pays out in our local Croatian Kunas, and uses a bad exchange rate for the foreign payments (so that I get less money!), please add 5% to the total price calculated in EUR  or US$.  Proceed further as instructed by the Western Union (i.e. send me all the necessary data to pick up the money).

2.4 Postal Money Order

Certain countries, almost all within Europe, but some also from around the world, have the international postal money order service with Croatia.  Go to your post office and see if this is so. However, since I am paid out in our local Croatian Kunas, and a bad exchange rate is used for the foreign currencies (so that I get less money!), please add 2.5% to the total price calculated in EUR  or US$.  Proceed further as instructed by the post office.

2.5 Sending Cash in an Envelope

Confronted with the high price of money transfer, a couple of customers (about 10 in the last 2 years) sent well wrapped cash hidden inside an envelope, to cover smaller payments. All of these were received unopened and with the cash inside. You can count on my full discretion in this matter, but please note that this will be completely at your risk.
If packing the cash in a mail, make sure that the money is not visible when the envelope is looked in front of light. Also make sure that the bills are fixed inside its cover (e.g. with a tin
y pieces of scotch tape), so that they cannot move and appear at the edges of the envelope.

2.6 Unacceptable Ways of Payment

This is to answer some frequently  asked questions on other ways of payments which are, unluckily, unacceptable for one or another  reason.

i) The credit cards are not acceptable. Since business and trading is not the primary purpose of my activities with old analog instruments, I do not own a merchant account (see also the Formal Notes on Collecting and Trading), and cannot accept credit cards of any kind. Also, this would be highly uneconomical because of the low number of transactions per year.

ii) The COD (Cash-On-Delivery) service is not acceptable. This service would be acceptable for cheaper items (like e.g. tape loops), but for very expensive items the risk that the customer will reject the order is too big. Also the COD is provided by state post services only within the country borders, and not internationally. Internationally it is provided by specialized companies which services are usually very expensive (see 3.b). 

iii) PayPal service is not available for payees in Croatia (to my disappointment). The PayPal service doesn't provide the payments to citizens of Croatia yet. I explicitly urged the PayPal company to provide me with their services, but they say that I cannot be the recipient because Croatia is (still) not on their list. Thus I cannot use the PayPal benefits like accepting credit-card payments.

iv) Other intermediary services like Trade-Safe are not acceptable. They are unsafe from the sellers standpoint. It is good for two people exchanging goods, when both of them are equally "unknown". I have the Web page about the Analog synths for more than eight (8) years now, and have gathered  reputation, which I presume infallible (if not already, please refer also to Paragraph 1). When using such services  it is a must to send the goods by some delivery companies like DHL, UPS or similar, which have the "package tracking system". All such companies are extremely expensive (4, 5 times more than ordinary post service). On the other hand, normal shipping by state posts usually doesn't have the tracking option, because one state post handles the goods to another state post in another country. Thus there are no guarantees for the seller to determine whether the buyer receives the goods or not, or in other words, the buyer can simply state that he or she has never received the goods and require the recollection of the paid sum.


3. Packing and Shipping

3.1 Packing

The shipping costs include also the packing of the goods.  The use of normal post services (see the Paragraph 3.a) requires professional quality packing, which is our obligation. While this is easy for e.g. a rhythm machine and some smaller items, it can be a complex task for a synthesizer. It includes building a professional quality packing box made to the measure of the instrument. It is made of solid cardboard with Styrofoam suspensions inside, thus fully protecting the instrument during the transport.

3.2 Normal Shipping

After you pay the negotiated price, including the shipping costs in one of the ways explained in the topic 2, I ship the goods to you.

3a. Shipping by the state postal service. This the most common and the recommended way of shipping. It is also the the cheapest way and very secure, though not always very fast. After a few dozens of deliveries, there where never problems with this kind of shipping. It usually takes one to two weeks (10 days on average) within Europe, without need for air freight. The overseas delivery will take longer time, 4-10 weeks, on average 5-6 weeks for surface service. Air Service is about 50% - 60% more expensive and takes about two weeks. The packing and shipping prices inside Europe, for a synth weighing 15-20 kg are about EUR 70-90 (surface). For USA, the corresponding price is roughly US$ 100-120, and air freight adds about 75% to the shipping costs. Smaller items, like rhythm machines will be shipped for much cheaper rates.

3b. There is a possibility to use high class delivery services like DHL or UPS,  with delivery time within a day or two. The "cash on delivery" option is however not acceptable because of extremely high shipping charge that would come to my bill if the buyer doesn't accept the goods. But their prices are usually very high. E.g. transportation from Croatia to European countries, for a package weighing 10 kg would cost EUR 200, for 15 kg EUR 250, and for 20 kg EUR 300.  If you care about your money, it's worth while to wait a bit longer and use the option 4a.

3.3 Other Ways of Delivery

3c. Another possibility is to transport to goods by bus to certain European destinations (Germany, Austria, Swiss) reachable by either regular bus routes. German and Austrian towns are especially well connected (Munich, Frankfurt, Stuttgart, Berlin, Vienna, ... ), for others we must check. The costs of this delivery are from EUR 75 up, and this solution requires a fully synchronized action from both sides. However, this can be quite suitable for heavier items (like Rhodes pianos, heavy organs, etc...) that are not accepted by post services because of the weight limit.
3d. Upon special requests,  there is a possibility to arrange the special transport to customers within Europe, by me, or somebody else, for an appropriate charge. This is economical only for large orders.
3e. You can pick the instruments yourself here in Croatia (http://www.hr/hrvatska/HR.html). Thus you can play them and check if this is what you want, and make the  payment on the spot. Croatia is a great place for holidays. Especially the Adriatic Coast is a well known summer vacation resort.

3.4 Checking of Goods upon Reception  

The buyer must pay special attention to the condition of the package upon its arrival. If the package is torn apart, deformed, or have any other signs of damage, the recipient must require that the package is open in front of an authorized officer, to check the condition of the package interior. If any kind damage is inspected, be it mechanical, chemical, moisture, fire or other, the recipient is obliged to help in pursuing further legal actions against the delivery company in order to get full refunds. In this case, the sender of the goods is not responsible for the damage. The sender (Robert Logozar) will return the money to the buyer only after he is paid off for the damage by the delivery service which caused the damage.

3.5 Minimizing Extra Expenses

Every buyer must be aware of the possible extra expenses due to the custom duties and/or taxes when the goods enter his or her country. In order to help you with the custom, I will always specify that the goods delivered are old, used and secondhand units, and will always act in a way to help you minimize the possible custom expenses. Due to my willing assistance in this matter assistance, no customers paid substantial customs duties until now (please contact us for the details).


4. Honesty and Trust

4.1 What is expected from me

It is obvious that making any kind of deal, especially via Internet relies on honesty and trust. I believe in honesty and will do my best to justify your trust. I will not risk to send you an instrument unless it is treated the way we agreed upon, and that is not checked, and double checked. I will always do everything within my power to save us both from unnecessary troubles and expenses.  I would rather cancel the deal, stating that instrument is out of order, or generally not deliverable. In other words: if I am not able to deliver whatever we have agreed upon for any of reasons, and you have already done the payment, you will receive the full refund, including the costs of the shipping (but excluding the money transfer fees).  If delivered goods are malfunctioning when you receive them, and this is not due to the bad postage handling (which can and must be recognized by recipient due to a bad condition of the package -- see the paragraph 3.4 above), you can send the malfunctioning items back to me and I will refund you the sum that you have paid in your payment  (the back-shipping costs are not included).
     I do understand that someone wants to have more guarantees. I myself have often encountered people who have cheated on me, were dishonest in one or another way, or did not perform the way we agreed upon. Contrary to that, I have never done that, and will never do that intentionally (see also Paragraph 1). For some other ways of doing the transaction, please see the options 3b, 3c, 3d and 3e.

4.2 What is expected from you

It is expected that you know what you order.  Once you have received the ordered goods, you are not allowed to change the deal because "you don't like the sounds" of the instruments that you had ordered, or for similar reasons. You have to know what you want, and what the instruments you had ordered should sound like.
